These End User Terms and Conditions ("Terms") govern your access to and use of MoMo+ in the Republic of Congo.
MoMo+ is a digital service connected to the MoMo ecosystem that enables eligible users to participate in Tontines, create or contribute to Gift Pots, and make contributions to approved Causes through the Give Back / Rends à ton Congo feature.
MoMo+ is offered by Mobile Money Congo S.A. ("MMC"), having its registered office at 36 rue avenue Amilcar Cabral, Brazzaville, Republic of Congo. The underlying service platform is provided by Maly Tech Ltd ("Maly"), a partner company of MMC headquartered in Dubai, UAE. MoMo+ is offered under MMC's brand and regulatory responsibility in the Republic of Congo.
By registering for, accessing, or using MoMo+, you confirm that you have read, understood, and accepted these Terms.

MMC may refuse access to, suspend, or terminate use of MoMo+ where eligibility requirements are not met or are no longer met.
When you register for MoMo+, your account is linked to your registered mobile number. You are responsible for:
You are responsible for all activities carried out through your account or registered mobile number, except to the extent such activity is proven to result directly from MMC's or its authorised service provider's fault.
5.1 Tontine
MoMo+ enables users to participate in digital group savings circles with invited participants. By creating, joining, or participating in a Tontine, you agree to the applicable contribution schedule, amount, order, and rules for that Tontine.
5.2 Gift Pot
MoMo+ enables users to create or contribute to a Gift Pot for a selected recipient within a defined period. The creator sets the recipient, the invited contributors, the contribution amount, and the Deadline.
5.3 Give Back / Rends à ton Congo
MoMo+ enables users to make contributions to approved Causes presented through the service.
5.4 Nature of Services
MoMo+ is a digital service that facilitates user contributions, group collections, and donations through the MoMo ecosystem. MoMo+ is not a deposit-taking institution, is not a bank, and does not provide investment or savings account products. Any funds processed through MoMo+ are used solely for the applicable service transaction and are not invested or managed to generate returns for users. No interest, yield, profit, or other financial return accrues to users in respect of any funds contributed, collected, pending, or transferred through MoMo+.
All payments made through MoMo+ are processed through your MoMo Account. By approving a transaction, you authorise the relevant amount to be debited from your MoMo Account, subject to your confirmation, sufficient available balance, successful processing, and any required security, fraud prevention, or compliance checks.
A transaction may fail, remain pending, expire, or not be processed if you do not approve it in time, your MoMo Account has insufficient funds, there is a network or system interruption, required checks cannot be performed, or the transaction is blocked, delayed, or declined for security, legal, or compliance reasons.
By participating in a Tontine, you acknowledge and agree that:
You remain solely responsible for your decision to join a Tontine and for your obligations within that group.
By creating or participating in a Gift Pot, you acknowledge and agree that:
Where one or more contributions are successfully collected before the Deadline but the total target is not fully met, the Gift Pot is classified as partially funded. Collected amounts in a partially funded Gift Pot will nevertheless be transferred to the designated recipient. By using the Gift Pot feature, you expressly accept this outcome.
A Gift Pot is classified as failed only where no contribution is successfully collected before the Deadline, in which case no transfer takes place.
By making a contribution through Give Back / Rends à ton Congo, you acknowledge and agree that:
MMC may display information relating to Causes for user convenience. Unless expressly stated otherwise, MMC does not independently guarantee the performance, outcomes, or representations of any Cause beyond the due diligence, controls, and checks applied by MMC for onboarding and publication of that Cause on MoMo+.
Use of MoMo+ may be subject to transaction fees, service charges, MoMo fees, telecom charges, or taxes as applicable in the Territory. The current fee schedule is published by MMC through MoMo+ and official MMC channels, and may be updated from time to time. You agree to pay all charges lawfully applicable to your use of MoMo+.

MMC may investigate any suspicious activity and may block, reject, reverse (where lawful), suspend, or report activity where fraud, misuse, legal breach, or compliance risk is suspected.
By using MoMo+, you agree that MMC and its authorised service providers (including Maly) may collect, use, process, store, and share your personal and transactional information as necessary to: register and manage your account; provide the service; process payments and contributions; maintain service quality and security; investigate complaints and disputes; detect and prevent fraud, misuse, and unauthorised access; and comply with legal and regulatory obligations.
Your information will be handled in accordance with applicable data protection laws of the Territory and MMC's Privacy Notice.
MMC will use reasonable efforts to keep MoMo+ available and functioning properly. However, MoMo+ may be unavailable, interrupted, delayed, restricted, or suspended from time to time due to maintenance, upgrades, technical faults, network issues, security incidents, regulatory requirements, force majeure, or causes beyond MMC's reasonable control. MMC does not guarantee uninterrupted or error-free operation at all times.
You acknowledge that payments and service actions may occasionally be delayed, fail, or remain incomplete. Where a transaction is not successfully completed, you may be required to retry the transaction or contact support.
MMC is not liable for losses arising from insufficient funds, user inaction, delayed approval, incorrect input, device or network failure, or circumstances beyond its reasonable control, except where such loss results directly from MMC's proven fault or from a mandatory legal obligation.
Except as otherwise required by applicable law, successfully completed Tontine contributions, Gift Pot contributions, and Give Back donations are not refundable solely because a user changes their mind.
MMC may review and, where appropriate, process a refund, reversal, or other corrective action where there is a proven technical processing error, a duplicate debit, a failed transaction with incorrect debit, fraud, unauthorised use, or any other circumstance where applicable law or MMC policy requires corrective action. Any refund or reversal decision is subject to verification, transaction review, and applicable system and regulatory requirements.
If you have a complaint, dispute, or request for assistance relating to MoMo+, you should contact MMC through the official customer support channels, which include:
You may be required to provide relevant details, including your registered mobile number, transaction reference, date, time, and a description of the issue.
MMC may suspend, restrict, or terminate your access to MoMo+ immediately or at any time if you breach these Terms; fraud, misuse, or unauthorised activity is suspected; your MoMo Account is suspended, blocked, closed, or becomes ineligible; MMC is required to do so by law, regulation, court order, or regulatory instruction; or continued access creates legal, compliance, operational, or security risk.
Upon suspension or termination: contributions already made to an active Tontine or Gift Pot remain subject to the rules of that Tontine or Gift Pot; pending contributions that have not yet been successfully processed will generally not be completed; any funds held in your MoMo Account remain governed by the separate terms applicable to that MoMo Account; and Cause donations already successfully processed remain final.
You may stop using MoMo+ at any time. Transactions already initiated remain subject to these Terms and the applicable service rules.
All intellectual property rights in MoMo+ belong as follows: the MoMo+ name, branding, trademarks, and user-facing content published by MMC in the Territory belong to MMC; the underlying platform, software, systems, and technology used to deliver MoMo+ belong to Maly; and all other rights belong to MMC, Maly, or their respective licensors, as applicable.
Your use of MoMo+ grants you only a limited, non-exclusive, non-transferable right to use the service for its intended purpose. It does not transfer any ownership rights to you. You must not copy, reproduce, modify, distribute, reverse engineer, or exploit any part of MoMo+ except as permitted by law.
To the fullest extent permitted by law: MoMo+ is provided on an "as available" basis; MMC is not liable for indirect, incidental, special, or consequential loss; MMC is not liable for losses caused by user error, insufficient funds, delays in approval, device issues, network outages, or events beyond its reasonable control; and MMC is not responsible for disputes between users of Tontines or Gift Pots, or disputes relating to contributions to Causes, except where such dispute is directly caused by MMC's proven processing error.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.
You agree to indemnify and hold harmless MMC, Maly, and their affiliates, officers, employees, agents, and service providers from claims, losses, liabilities, damages, costs, and expenses arising out of your breach of these Terms, your misuse of MoMo+, your unlawful activity, your infringement of the rights of any third party, or fraudulent or unauthorised activity attributable to your acts, omissions, or negligence.
MMC may modify, update, suspend, discontinue, or restrict any part of MoMo+ at any time for legal, regulatory, security, technical, operational, or commercial reasons.
MMC may also amend these Terms from time to time. MMC will provide reasonable prior notice of material changes through MoMo+ or official MMC channels, and such changes will become effective no earlier than fifteen (15) days after notice, unless a shorter period is required by law or regulation.
Your continued use of MoMo+ after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you must stop using MoMo+.
These Terms are governed by the laws of the Republic of Congo and any applicable regulatory requirements governing services offered in the Territory.
Any dispute, complaint, or claim arising out of or in connection with MoMo+ should first be submitted through the official customer support and complaint channels referred to in Section 17.
If the matter is not resolved through that process, it may be referred to the competent courts of the Republic of Congo, in accordance with applicable laws.
These Terms are issued in English and French. In case of any conflict or inconsistency between the two language versions, the French version shall prevail.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
These Terms constitute the entire agreement between you and MMC in relation to your use of MoMo+, unless additional specific terms are presented to you for a particular service or transaction.
